this is ooc and i’m sorry but look. i feel like anne rice is totally dickish with her total ban on fanfiction/lack of interaction with fandom, etc, but 1. it’s her right to not want to participate in fandom and 2. she’s kind of right? at this point there are, off the top of my head, at least 2 hugely popular series right now that are complete rip-offs of other popular series (50 shades/twilight & mortal instruments/harry potter, both of which began as fanfics but are now almost —

[2nd ask sent] – almost entirely just a complete theft of the intellectual property that they started as fan-derivative works of. so i don’t know if half of what op claims is fair? because it’s true that anne rice chased away her online fandom with a broom, but it’s not totally baseless given the circumstances. she’s not just some crazy old lady imo. sorry again, i don’t want to start a fight but i don’t agree.


Okay, so this is a HUGE topic and I could write an essay and a half on all the issues raised, but it DOES sound like you’re trying to start a fight, partly bc you submitted this on Anon (and you started w/ “this is ooc” so it’s clear you’re an RPer, infringing on the VC copyright through RP, which is writing fanfic, for free!) and partly bc of your general tone, which in all fairness I could be misreading.

I’m not sure you totally understand AR’s War on Fanfic in the early-mid 90′s, or the actual points raised in the post you disagree with so strongly, so that’s why I’m taking the time to answer. 

However, for everyone’s future reference: my policy has been to answer every Ask I get but that policy is changing NOW. If I get the feeling that a message is provocative in a negative way, I won’t answer it publicly. Privately, I might, if you come off Anon.

2) @the-savage-nymph-art​ replied to that question [X]. Brilliantly and succinctly, I would add. They even provided one of the purposes of fanfic: to share headcanons. Whether in an AU, or PWP, etc., we’re exploring the characters through storytelling. 

What @the-savage-nymph-art​ didn’t mention is that exploring canon through writing/sharing fanfic (both for-profit and not-for-profit, I assume) predates AR’s War on Fanfic. You can do your own research on that, but here’s a good article to start with, by Ewan Morrison. 

And another great article by

Monika Bartyzel: talks about derivative works based on fanfic (it mentions 50 Shades & Twilight, too), but focusing on the Mortal Instruments. The thrust of the argument is that TMI was TOO derivative:

“…But until a story is willing to break through the boundaries of its inspiration and drop the mimicry in favor of its own voice, it will always be as derivative as its origins — no matter how many names you change.”

(^So there is a difference between fanfic that shares headcanons to explore, and fanfic that seems to merely mimic the canon it’s derived from.)

What @the-savage-nymph-art​ ALSO didn’t mention is that fanfic was shared for FREE when AR had her War on fanfic in the early-mid 90′s. This was to prevent the writing/sharing of fanfic that was not-for-profit. She was suing people because “It upsets me terribly to even think about fan fiction with my characters.” Not that she was concerned about the fanfic writers making money off their works, since they were being written/shared for FREE. Specs (short for “Speculative Fiction,” as they were called at that time) often had disclaimers at the top that the works were “written for love, not profit. Characters © Anne Rice” (and some fanfic authors continue to include these in various forms).


Anon, Anne Rice no longer has an issue with Fanfic. I don’t remember what year this was posted on FB but it was, and she hasn’t mentioned it since, that I’m aware of.

^So really, with that, the argument is kind of over. 

But I am definitively saying, I run this blog as respectfully of Anne Rice as I can, w/ just a little light teasing bc we do that even to our own parents! she’s given us a great gift in the VC. 

This blog is about positivity and inclusivity, and arguing over whether a derivative work is worthy of being considered worth standing alone as a separate work, that’s for the courts to decide on a case-by-case basis as we define what is a “derivative” work. There are some fanworks that I love so much that I WISH they were canon, that I WISH I could buy as a beautiful physical book to repay the creators for bringing me Such Feels!

Anon’s argument has 2 points: 

A) That fanfic written for fandom and then altered by changing the character names, etc. (aka ”filing the serial numbers off”, “Hermione” becomes “Eloise” or whatever) so that it can be sold for profit, is infringing on the copyright of the original creator. Anon mentions 2 examples that are making tons of money. I’ve heard of those series and the accusations of their beginnings as fanfic. I haven’t read them or followed the reviews about them though, so I can’t comment on whether or not they really are derivative works.

B) That Anne Rice is wrongfully accused of being “just some crazy old lady” in defense of the her VC copyright.


As per Anon’s point A), this is a nebulous thing, copyright law is still being worked out for it. It’s slowly developing on a case-by-case basis, and sometimes it’s settled out of court. Look at the Unofficial Harry Potter Encyclopedia case, for example. Not a fanfic, but still, a fanwork. The judge ruled that the

Unofficial Harry Potter Encyclopedia could be published for profit, in an abridged version of how it was originally intended to be, bc it served as a reference work, so it had value, but in its entirety it would have been

unfair competition w/ a similar work that J.K. Rowling intended to release (and she is still working on, years later).

As for your point B):

Nowhere in @the-savage-nymph-art​‘s reply is Anne Rice referred to as “just some crazy old lady.” In fact, it was only you, Anon, who called her “dickish.” 

Actually, there are several mocking references in @the-savage-nymph-art​‘s commentary to those who write fanfic, in the usual Tumblrland Hyperbole™ kind of way, which is intended to grab your attention and add a little levity to a serious and saddening topic. Don’t you get the joke, Anon? Silliness! Or can you not take it as humorous when smne mentions “your gloriously blushing butt-cheeks” ? 

I disagree with you, Anon. Anne Rice has given us an incredible gift. Yes, I have mentioned that she waged War on Fanfic. That’s a fact. It’s actual history.

Fanfic sold for money w/ the serial numbers filed off, (like 50 Shades does to Twilight and the Mortal Instruments *allegedly* does to Harry Potter) well, the creators of the original works have every right to pursue copyright protection! Have they, in these cases? Because the authors of 50 Shades and the Mortal Instruments seem to be doing fine, getting movie deals an all.   

Maybe the authors of 50 Shades and the Mortal Instruments were sued and settled out of court. 

But maybe, in these cases, the derivative work (as Anon calls them) was sufficiently AU of the fandoms they were adapted from to constitute enough originality to be considered works that stand on their own.

Let’s see what happens when someone writes fanfic w/ the serial numbers filed off based on 50 Shades and the Mortal Instruments!

Oh wait, 50 Shades already has a parody of it, 50 Shades of Black. Let’s get popcorn and see if a legal dispute fires up…

I weirdly love that there are crotchety fandom elders around who say shit like “in my day, (insert fandom term) meant this specifically, but now you kids just use it to mean any old thing.”

However, a massive revamp (pun intended har har) of this blog is in the works. If I may be self-deprecative for a moment, I’ve looked at it for over 2 years, so hit the jump for a list of what assaults my eyeballs when I look at this blog now.

The logo is safe, feedback already received on that, and the content will still be what you’ve come here for ^______^ The mission statement is still “Bursting blood vessels through fanworks!” But OVERALL it needs a more harmonized style, a touch of maturity in the color scheme, bc this thing has changed me. I’m not the same person who started this thing as mainly a cloud storage for the fanart I’ve collected. It’s grown into smtg so so much richer than that *u*

Fortunately, my longest RL VC friend (can you believe she has tolerated me for 20+ years?? She is my sister from another mister) is a programmer and she is gonna hold my hand through the process.


Stuff that assaults my eyes:

  • The layout of the tiles,
  • not enough tiles,
  • the Like and Reblog buttons. I don’t like them as text. I think I want to make them the familiar symbols. And larger.
  • the color scheme… I am kind of sick of slate-grays and purples 😛
  • too many font colors
  • the difficulty of reading the text against the individual post BGs…
  • the current bloodied-wall/distressed-velvet background. It’s not grunge, it’s too high-contrast, it’s an assault 😛
  • Could think of more, but that’s the worst of it, for now.

Real talk here, though: I love that they chose a realistic woman for Claudia to want to be, not some stick-figure blonde. Later, the lady killed on stage at the Theatre Des Vampires is more like that ideal, society’s projected perfection, but we’re not talking about her right now. This woman has kind of unusual boobs, as far as what we normally see in film, these are natural boobs, not hiked up in a bra to conform to some kind of perky ideal, and this woman has an actual tummy, maybe she’s had children, maybe she’s pregnant, either way, she appears to have FLESH THAT FUNCTIONS and is natural. “Pure Creole” as Lestat says appreciatively. And she’s kind of humming to herself, doing some kind of treatment to her body, just at peace with herself and the world, it seems. Claudia wants ALL of that.

Later, we see Claudia humming (the same tune?!) as she draws from this model trying to achieve that same inner peace. Why do artists art? One reason is they’re trying to capture an ideal and/or something ephemeral, something that brings peace when you can put it down on paper. Writing can achieve that, too, as can making music, as can all the creative arts.

That’s definitely part of why I’m an artist. It’s a burning need to capture and become something through the creative act. An evolution of sorts.

You see why I’m trapped in this fandom? It touches on everything! I can never leave.

2. ROLLERBLADING

Yes, as a child of the early 90′s, I have always been into rollerblading when the weather’s appropriate for it. The challenge is in finding a place to do it, which is tough, bc there are little kids and dogs to be run over EVERYWHERE in the city. 

Here I am equipped w/ wristguards bc I broke my left wrist on rollerblades about 10 yrs ago and I don’t need a repeat of that experience ever. Took this pic awhile ago, back when I was not smiling for selfies. Also featured: my actual real curly hair which I usually straighten bc of reasons I could go into if u really want to know. 

I have also changed my couch covering since then, no more hot pink! But I do still have that blanket and use it when it gets bitter cold here.

3. Handmodeling

I have an off-and-on career as a hand model and even tho I hardly do it anymore (scheduling conflicts mostly), I really liked it, and I still think my hands are aesthetically pleasing. Like c’mon, look at those airplane-hangar shaped nails! 100% REAL.

4. NYC

As u may or may not have gathered by now, I live in New York City. It’s pretty cool. Yeah. I live on the West side, near Columbus Circle. So if there’s anything you need photographed in NYC, I might be willing to go do it for ya!

But that menu includes very good French Toast. I have received rave reviews from actual foodies so I know it’s not just my bias. That’s turkey bacon with it. 10/10 would bang highly recommend.

State of the I-Want-My-IWTV

Note from the Addict: my very modest not ridiculously ambitious at all 2016 VC Goals

It’s the end of Jan. already! and I felt like I should share a little glimpse of what’s rolling around in my mind at the start of this new year, in terms of this blog. A “State of the I-Want-My-IWTV” address, if you will.

I don’t do Follow Forevers because I wouldn’t want anyone to feel left out. This thing is mine but I appreciate you all and love that you love this crazy stuff that I love, too! It’s a daily gift to me to get messages from you, scroll through the activity feed and see how you’ve tagged the stuff you’ve reblogged, but even if all you do is Like stuff, just seeing your urls brightens my day. I can’t thank you enough for sticking with me.

This was never about the number of followers for me, and it never will be. I’d still do this without any followers, but you all make it SO MUCH BETTER. You guys would easily fill an auditorium at this point. We could watch the next VC movie together! I fantasize about that but let’s stop this emotional outpouring for now…


On a personal note…I just bit the bullet and hired a personal trainer! I’m meeting with him 2x/week until May and gonna get into better shape, I have the money and I’ve run out of excuses not to do it. I’d like to do videos to answer asks sometimes and currently I’m just a little camera shy, y’know? Would you want short video answers? Or do you prefer it written?

All this means is I’ll be around here less until May. Then the weather will be nicer and I’ll be trying to keep up the momentum being outside. Possibly playing sports with other humans ewwwww… 

ANYWAY I have all these dreams for this blog and it’s purpose… for 2016:

  1. Layout makeover in progress, still in design phase (Yes I know the top right buttons are missing, they’re actually hiding under the top bar, gonna fix this wknd, hopefully)
  2. Asks – I want to CLEAR my inbox of all the 2015 messages (I have asks from Halloween *blushes furiously*). I have never deleted a message without responding publicly or privately. Sometimes I save an ask bc it’s a difficult one and requires research, or needs a gif/pic assemblage made, etc. Sometimes I save it bc it’s so sweet and it hits me Right in the Feels and I can’t even respond immediately, and then it gets buried before I can reply. That’s a good thing for me though, bc then I find it again, inevitably, on a day when I really need it, so it has double the impact ❤
  3. Self makeover – as mentioned already, so I can be in videos and also maybe someday really be an advocate for our fandom. Not that I think this would really happen, but I would love to somehow get in touch with the people working on the new VC adaptations tell them how to do their fucking jobs *ahem* and get a little communication going w/ them, bc if they’re going to sell it to us, they could benefit from the advice of people who care deeply about this canon, and have useful headcanons to share that would only enrich them *u*
  4. Fanart commissions – I want to promote more of this! It’s partly selfish, because I want to see more of it on my dash; we all benefit when people get commissions and then share them publicly ;D
  5. Fanfic/fanworks and Intellectual Property Law – Continuing to learn more about this so I can keep you informed about what’s fair use and what’s not, since our fandom had to deal with bloody fanfic wars in the 90’s and we don’t need a repeat of that. EVER.

So yeah that’s not overly ambitious at all, is it? IT IS. I’ll just repost this in 2017, har har.
